Terms of Service
These Terms of Service ("Terms") form a legal agreement between you and TechGenie Ltd ("TechGenie", "we", "us", or "our"), the company behind Recruitr. By accessing or using Recruitr at recruitr.techgeniehq.com ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account or using any part of the Service, you confirm that you are at least 16 years old, have the legal capacity to enter into this agreement, and accept these Terms on behalf of yourself or the organisation you represent. If you are accepting on behalf of an organisation, you represent that you have the authority to bind that organisation.
These Terms apply to all users of the Service, including users on free plans, paid subscribers, and members of team workspaces.
2. Description of Service
Recruitr is an AI-powered recruitment platform that provides tools including CV screening, candidate outreach drafting, interview question generation, offer letter creation, a hiring pipeline manager, and an AI assistant (Curie). The Service is provided on a software-as-a-service basis. We may add, modify, or discontinue features at any time with reasonable notice.
The Service is designed for professional recruitment and hiring purposes. It is not intended for consumer use and is directed at businesses, recruitment agencies, and HR professionals.
3. Account Registration and Responsibilities
To use the Service you must create an account. You agree to:
- Provide accurate, current, and complete registration information and keep it up to date.
- Maintain the confidentiality of your login credentials and not share them with others.
- Notify us immediately at legal@techgeniehq.com if you suspect unauthorised access to your account.
- Accept responsibility for all activity that occurs under your account, whether or not authorised by you.
We reserve the right to suspend or terminate accounts where we reasonably suspect fraudulent, abusive, or illegal activity.
4. Acceptable Use
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to send unsolicited bulk communications (spam) to candidates or any other individuals.
- Use the Service to discriminate unlawfully against candidates on the basis of age, sex, race, religion, disability, sexual orientation, or any other protected characteristic.
- Upload, transmit, or process any content that is unlawful, harmful, defamatory, obscene, or that infringes third-party intellectual property rights.
- Attempt to reverse-engineer, decompile, or extract source code from the Service or its underlying AI models.
- Use automated scripts, bots, or scrapers to access the Service in a manner that exceeds normal human interaction or that adversely affects our infrastructure.
- Circumvent usage limits, rate limits, or any technical access controls.
- Resell, sublicense, or otherwise provide the Service to third parties without our written consent.
- Use the Service to develop a competing product or service.
- Introduce malware, viruses, or any code intended to compromise the integrity of the Service or other users' data.
Violation of these acceptable use rules may result in immediate account suspension, termination, and, where applicable, referral to law enforcement.
5. AI-Generated Content Disclaimer
The Service uses Claude, Anthropic's large language model, to generate assessments, draft communications, suggest interview questions, and provide other AI-assisted outputs ("AI Outputs").
AI Outputs are suggestions only and do not constitute professional, legal, HR, or recruitment advice. They are provided to assist your judgement, not replace it. You are solely responsible for reviewing, verifying, and acting upon any AI Output before using it to make or inform hiring decisions.
We do not warrant that AI Outputs are accurate, complete, free from bias, or fit for any particular purpose. AI models can produce plausible-sounding but incorrect or inappropriate content. You must exercise your own professional judgement and comply with applicable employment law, including equal opportunities obligations, when using AI Outputs in your hiring process.
We are not liable for any hiring decisions, legal claims, or other consequences that arise from reliance on AI Outputs.
6. Intellectual Property
6.1 Our IP
TechGenie owns all rights, title, and interest in and to the Service, including its software, design, branding, trademarks, and underlying technology. Nothing in these Terms grants you any ownership rights in the Service. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service during the term of your subscription in accordance with these Terms.
6.2 Your Content
You retain ownership of all content you submit to the Service (job descriptions, notes, email drafts, and similar). By submitting content, you grant TechGenie a limited licence to process that content solely to deliver the Service to you. We do not use your content to train AI models.
6.3 AI Outputs
Subject to these Terms and any applicable law, AI Outputs generated through your use of the Service are assigned to you. TechGenie makes no claim to ownership of AI Outputs produced for your account.
7. Payment Terms
7.1 Plans and Pricing
Recruitr offers a Free tier and paid subscription plans (Starter, Pro, and Enterprise). Pricing is published on our pricing page and may change with at least 30 days' notice to existing subscribers.
7.2 Billing
Paid plans are billed monthly or annually in advance. All payments are processed by Stripe. By subscribing, you authorise TechGenie to charge your payment method at the beginning of each billing period. Taxes (including VAT) may apply depending on your jurisdiction.
7.3 Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until then. We do not offer prorated refunds for partial billing periods, except where required by applicable consumer protection law.
7.4 Failed Payments
If a payment fails, we will notify you and retry the charge. If the outstanding amount is not settled within 7 days, we may downgrade your account to the Free tier and suspend access to paid features until payment is made.
8. Data Processing
Our collection and use of personal data — including data relating to candidates — is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
To the extent that you use Recruitr to process personal data of candidates or other individuals on behalf of a data controller, you acknowledge that you are responsible for ensuring you have a lawful basis for that processing and that candidates have been informed appropriately.
9. Availability and Service Levels
We aim to provide a reliable Service but do not guarantee uninterrupted availability. We may perform maintenance, updates, or emergency interventions that cause temporary unavailability. We will provide reasonable advance notice of planned downtime where possible.
The Free tier is provided "as is" without any uptime commitment. Paid plans are subject to reasonable commercial efforts to maintain availability; specific SLA terms for Enterprise plans are agreed separately.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- TechGenie is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
- TechGenie's total cumulative liability to you for any claims arising under these Terms shall not exceed the greater of (a) the fees you paid to TechGenie in the 12 months preceding the claim or (b) £100.
- We are not liable for decisions made using AI Outputs, failures of third-party services (Supabase, Anthropic, Stripe, Google, Resend), or data loss caused by circumstances outside our reasonable control.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless TechGenie and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or the rights of any third party; or (c) any content you submit to the Service.
12. Termination
12.1 By You
You may close your account at any time from your account settings. On account closure, we will delete your personal data in accordance with our Privacy Policy.
12.2 By Us
We may suspend or terminate your account immediately, without notice, if you breach these Terms, engage in illegal activity, or if we are required to do so by law. We may also terminate the Service entirely with 30 days' notice to all users.
12.3 Effect of Termination
On termination, your licence to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will continue to apply.
13. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or via a prominent notice in the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Service and close your account before the effective date.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where applicable consumer protection laws give you the right to bring proceedings in your country of residence.
Before initiating formal legal proceedings, we encourage you to contact us at legal@techgeniehq.com to attempt to resolve the dispute informally.
15. Miscellaneous
- Entire agreement — These Terms, together with the Privacy Policy and any order forms or enterprise agreements, constitute the entire agreement between you and TechGenie relating to the Service.
- Severability — If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
- Waiver — Failure to enforce any provision is not a waiver of our right to enforce it in future.
- Assignment — You may not assign your rights under these Terms without our prior written consent. We may assign our rights as part of a merger, acquisition, or sale of assets.
- No partnership — These Terms do not create a partnership, joint venture, or employment relationship between you and TechGenie.
